Sardar Hajj Qasem Soleimani Assassination and International Law
According to international law, the targeted action of Pentagon and Mr. Trump was a clear example of assassination and violation of international human rights.
According to International laws and regulations, using deliberate or potentially lethal force is mandatory when the person or persons concerned pose an “imminent” threat to other human life. So just past claiming of intervention in attacks on American positions and interests cannot be considered “legitimate” for targeting them to kill.
On the other hand, according to the human rights laws, killing anyone except for the intended purpose would be an arbitrary deprivation of their lives. Therefore, it has governmental responsibility and individual penalties, too.
The justification for the necessity of preventive defense by Pentagon and Mr. Trump himself will not be acceptable. Since the use of deadly forces is only possible when there is an “immediate and pervasive threat” and there is “no other option” to respond or response time is limited. So the case did not meet the above conditions and therefore it cannot be accepted.
According to international law, governments can resort to military attacks when it is based on “self-defense” rather than “arbitrary military strikes", and even in this case ” appropriate actions should be taken". However, That wasn’t the case.
This attack is undoubtedly an invasion of the sovereignty of the country. Since, Iraq, as an independent state and a member of the United Nations like any other country, has “territorial sovereignty rights". So the US airstrike was a violation of Iraqi national sovereignty, assassinate, and entrance to Iraqi airspace.
It is worth mentioning that assassinate as an action of international fear which is causing growing terror is regarded as an international crime. And based on Article 2 of the Rome Statute, Mr. Trump will be “an international criminal” and He will be prosecuted by the International Criminal Court.
As stated above, any Iranian counter-action against the United States of America is “legitimate” under international law and is called a “reciprocal action".
victory is from Allah and conquest is imminent.
